1. Acceptance of Terms

By accessing or placing an order through shop.tomenterprise.org, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms of Service in full. If you do not agree, you must not use this store.

2. About TOM Enterprise

TOM Enterprise is an Arizona nonprofit corporation and creative incubator organized exclusively for charitable and educational purposes under Section 501(c)(3) of the Internal Revenue Code (application pending). Our mission is to equip creative entrepreneurs with world-class branding, strategic mentorship, and financial literacy — on a sliding-scale model so that financial barriers never prevent a qualified founder from building a lasting legacy.

The store at shop.tomenterprise.org is the commerce branch of TOM Enterprise, offering physical merchandise, packaged service offers, and program enrollment products. For general information, programs, and intake, visit the main site at www.tomenterprise.org.

3. Products & Services Offered

The store may offer:

  • Physical merchandise — branded apparel, materials, and promotional products

  • Packaged service offers — Brand Identity Development, Strategic Business Planning, Financial Literacy Workshops, 1-on-1 Mentorship, Creative Direction, and Legacy Builder Cohort enrollment

  • Digital products — downloadable guides, templates, and educational resources

  • Gift cards — store credit for future purchases

All service packages are delivered under a separate executed Service Agreement and Statement of Work (SOW) upon enrollment. Purchase of a service package through the store constitutes an intent to enroll and initiates the intake process, but does not constitute a complete enrollment until a Service Agreement is executed.

4. Sliding-Scale Pricing & Tier Placement

TOM Enterprise operates on a nonprofit sliding-scale pricing model ranging generally from $0 to $3,000 depending on the service and verified financial need. Pricing tiers are:

  • Tier 1 — Scholarship ($0): Demonstrated financial need; full participation requirements apply.

  • Tier 2 — Subsidized ($250–$1,500): Moderate financial need; sliding scale based on income and availability.

  • Tier 3 — Standard ($1,500–$3,000): Full market rate; no financial need documentation required.

You agree to provide truthful and accurate information if applying for a subsidized or scholarship tier. TOM Enterprise reserves the right to adjust tier placement if eligibility information is found to be materially inaccurate. Tier placement confirmed at enrollment is final and cannot be retroactively changed.

5. Payments

All payments are processed securely through Shopify's payment infrastructure. By completing a purchase, you authorize the charge to your selected payment method. Prices are listed in U.S. dollars and are subject to change without notice. Payment schedules for multi-session or phased service packages are outlined in the executed SOW. Late or missed payments may result in paused service delivery or withheld final deliverables until the balance is satisfied.

6. Refunds & Returns

All refund and return requests are governed by our separate Return & Refund Policy, available at the footer of this store. Key provisions include:

  • Physical merchandise may be returned within 14 days of delivery, subject to condition requirements.

  • Service packages are non-refundable once service delivery has begun.

  • Digital products are non-refundable once accessed or downloaded.

  • Cancellations must be requested before fulfillment or shipping.

The full policy is incorporated by reference into these Terms.

7. Intellectual Property

Unless otherwise specified in an executed Service Agreement, all TOM Enterprise content — including but not limited to curricula, workshop materials, program frameworks, brand assets, logos, copy, templates, and educational methodologies — remains the exclusive intellectual property of TOM Enterprise. You are granted a limited, non-exclusive, non-transferable license to use purchased materials solely for your personal business development purposes. You may not reproduce, distribute, resell, or create derivative works from TOM Enterprise content without prior written consent from the Executive Director.

Client-specific deliverables (final logo files, brand guidelines, approved business plans) are transferred to the client upon full satisfaction of all payment and participation obligations as outlined in the executed Service Agreement.

8. AI-Assisted Operations Disclosure

TOM Enterprise's intake, scoring, and communication workflows are partially AI-assisted. Our Surgical Logic intake system uses AI agents to score applications, draft communications, and route leads. All final decisions regarding program enrollment, scholarship awards, and tier placement are made by the human founder and Executive Director, Tralynn McCullar. You have the right to request human-only review of any AI-assisted decision at any time by contacting support@tomenterprise.org.

9. Educational Disclaimer

All content, workshops, mentorship sessions, and materials provided by TOM Enterprise are for educational and informational purposes only. Nothing provided through the store or TOM Enterprise programs constitutes legal, financial, tax, accounting, or investment advice. You are solely responsible for your own business decisions and outcomes. TOM Enterprise does not guarantee specific business results, profit levels, or the success of any venture.

10. Community Standards

TOM Enterprise is a community-centered organization. By participating in any program, cohort, workshop, or service, you agree to engage respectfully with staff, mentors, and fellow participants. TOM Enterprise reserves the right to remove any participant who engages in discriminatory, harassing, threatening, or exploitative conduct, with or without refund depending on the stage of service delivery.

11. Limitation of Liability

To the maximum extent permitted by Arizona law, TOM Enterprise's total liability to you for any claim arising from your use of this store or participation in any program shall not exceed the total amount you paid for the applicable service or product. TOM Enterprise is not liable for any indirect, consequential, incidental, special, or punitive damages arising from your use of the store, reliance on program content, or business decisions made based on TOM Enterprise services.

12. Indemnification

You agree to indemnify, defend, and hold harmless TOM Enterprise, its directors, officers, employees, volunteers, mentors, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from your use of the store, your violation of these Terms, or your violation of any third-party rights.

13. Third-Party Links & Platforms

This store may contain links to external platforms including www.tomenterprise.org, Acuity Scheduling, and HubSpot intake forms. TOM Enterprise is not responsible for the content, privacy practices, or terms of any third-party platforms.

14. Privacy

Your use of this store is also governed by our Privacy Policy, available at the footer of this store and at www.tomenterprise.org. By using the store, you consent to the collection and use of your information as described in that policy, including processing through our HubSpot CRM and n8n automation infrastructure.

15. Modifications to Terms

TOM Enterprise reserves the right to update or modify these Terms at any time. Changes will be posted to this page with an updated effective date. Your continued use of the store after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed under the laws of the State of Arizona, without regard to conflict of law principles. Any legal action or dispute arising from these Terms or your use of this store shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.
